Terms of Service

These Terms constitute a legally binding agreement between you ("User", "Client", "you") and Access Data Global Pvt Ltd, registered under the laws of India. By creating an account, booking a demo, or otherwise using the Service, you confirm that you are at least 18 years of age and have the authority to bind your organisation.

Access Intelligent is a SaaS real-estate CRM platform. Access Data Engine is a Data-as-a-Service platform delivering structured market data across multiple industries. Together they include, but are not limited to:

• Intelligence Hub — AI-driven market forecasting, GIS heatmaps, and property matching.
• WhatsApp engine — automated messaging via the official Meta Business WhatsApp API.
• Smart Kanban pipeline — visual deal-stage management and automation.
• Autonomous data pipeline — multi-source extraction with deduplication and an API.

Access to paid features requires an active subscription, billed monthly or annually in advance. All fees are non-refundable except as explicitly stated in our Refund Policy or required by applicable law.

• Pricing is displayed in INR, USD, GBP, or AUD based on geo-detection, and can be switched manually.
• Prices may change with 30 days' notice. Continued use after a change constitutes acceptance.
• Late payments may result in temporary suspension of access.

Your use of the WhatsApp engine is subject to the WhatsApp Business Policy and Meta Platform Terms. You agree to:

• Only message contacts who have explicitly opted in to receive communications from your business.
• Not use the WhatsApp engine for spam, unsolicited bulk messaging, or prohibited content.
• Maintain accurate business information and a compliant message-template library.
• Immediately cease messaging any contact who opts out or requests removal.

Violation of Meta's policies will result in immediate suspension of your WhatsApp engine access without refund. We reserve the right to terminate your account for repeated or egregious violations.

You agree not to:

• Reverse-engineer, decompile, or attempt to extract source code from the Service.
• Use the Service to transmit malware, ransomware, or any malicious code.
• Resell, sublicense, or white-label the Service without a separate written agreement.
• Use the Service in any manner that violates applicable laws, regulations, or third-party rights.
• Attempt to gain unauthorised access to systems, data, or other accounts.

All intellectual property rights in the Service — including the data-extraction engine, platform design, algorithms, trademarks, and content — are owned exclusively by Access Data Global Pvt Ltd or its licensors.

You retain ownership of all data and content you upload ("Client Data"). You grant us a limited, non-exclusive licence to process Client Data solely to provide the Service.

Our handling of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. For enterprise clients requiring a Data Processing Agreement (DPA) for GDPR or DPDP Act compliance, contact legal@accessdataglobal.com.

To the maximum extent permitted by applicable law, Access Data Global Pvt Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, revenue, data, goodwill, or business opportunity — arising from your use of or inability to use the Service. Our total aggregate liability shall not exceed the fees paid by you in the 3 months immediately preceding the claim.

Either party may terminate the agreement with 30 days' written notice. We may terminate immediately if you breach Sections 4 or 5, or if required by law. Upon termination, your access ceases and your data is retained for 90 days before permanent deletion, subject to legal requirements.

These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of the courts located in Chennai, Tamil Nadu. For international clients, disputes may be resolved by binding arbitration under the UNCITRAL Arbitration Rules.

We reserve the right to modify these Terms at any time. We will notify you at least 14 days before material changes take effect via email or in-app notice. Continued use after that date constitutes acceptance of the revised Terms.
